Welcome to ZipCoApply. These Terms of Service ("Terms") govern your use of the ZipCoApply website located at zipcoapply.com ("Website") and all related services provided by ZipCoApply ("Service"). By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

1. Description of Service

ZipCoApply is a loan connection service that helps connect consumers seeking personal loans with third-party lenders and financial service providers. We are NOT a lender, do not make loans, do not make credit decisions, and do not broker loans. We are a lead generator and marketing service that submits consumer information to lenders and financial service providers.

The actual loan terms, including interest rate, APR, loan amount, fees, and repayment terms, are determined solely by the lender. We have no control over and are not responsible for the actions or decisions of any lender.

2. Eligibility

To use our Service, you must:

  • Be at least 18 years of age
  • Be a legal resident of the United States
  • Have a valid Social Security Number
  • Have an active checking account
  • Have a regular source of income
  • Have a valid email address and phone number

By using our Service, you represent and warrant that you meet all eligibility requirements.

3. User Obligations

When using our Service, you agree to:

  • Provide accurate, current, and complete information in your loan application
  • Not provide false or misleading information
  • Not use the Service for any unlawful purpose
  • Not attempt to interfere with or compromise the system integrity or security
  • Not attempt to gain unauthorized access to any portion of the Service
  • Not use the Service to transmit any viruses, malware, or harmful code

4. No Guarantee of Loan Approval

Submitting an application through our Service does not guarantee that you will be connected with a lender or that you will receive a loan offer. Loan approval is at the sole discretion of the lenders in our network. Factors that lenders consider may include, but are not limited to, credit history, employment status, income, and other financial information.

5. APR and Loan Terms Disclosure

Personal loan APRs through our lender network typically range from 5.99% to 35.99%. The APR you receive depends on your credit profile, the lender, loan amount, and loan term. Loan amounts range from $500 to $5,000 with repayment terms from 3 to 24 months.

Example: A $2,500 loan with a 24.99% APR repaid over 12 months would have monthly payments of approximately $236.89 and a total repayment amount of approximately $2,842.68.

All APR rates, terms, and fees are determined by the individual lenders and will be disclosed in any loan offer you receive.

6. Consent to Receive Communications

By submitting your information through our Service, you expressly consent to receive communications from ZipCoApply and our lending partners. These communications may include:

  • Emails regarding your loan application status
  • Phone calls from lenders regarding loan offers
  • SMS/text messages about your application (standard messaging rates may apply)
  • Marketing communications about products and services

You may opt out of marketing communications at any time by following the unsubscribe instructions provided.

7. Credit Checks and Reporting

By using our Service, you authorize lenders in our network to obtain your credit report from one or more consumer reporting agencies. Initial inquiries may be "soft pulls" that do not affect your credit score. If you accept a loan offer, the lender may perform a "hard pull" credit inquiry, which may impact your credit score. Additionally, your payment history on any loan may be reported to credit bureaus.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

9. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of ZipCoApply. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of ZipCoApply.

Our Service may contain links to third-party websites or services that are not owned or controlled by ZipCoApply. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that ZipCoApply shall not be responsible or liable for any damage or loss caused by use of any such content, goods, or services available on or through any such websites or services.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. ZIPCOAPPLY MAKES NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE SERVICE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZIPCOAPPLY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of or inability to access or use the Service
  • Any conduct or content of any third party on the Service
  • Any content obtained from the Service
  • Unauthorized access, use, or alteration of your transmissions or content

13. Indemnification

You agree to defend, indemnify, and hold harmless ZipCoApply and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to your violation of these Terms or your use of the Service.

14. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

15. Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules. The arbitration shall take place in Delaware, and the arbitrator's decision shall be final and binding.

16. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
